Terms of Service

These Terms of Service (“Terms”) govern your use of the FlashFender dealership management service and flashfender.com, operated by FlashFender Technologies Inc. (“FlashFender”, “we”, “us”). By creating an account or using the Service, you agree to these Terms.

1. The Service

FlashFender is a dealership management system for Canadian independent used-car dealers: inventory, CRM/leads, deals & F&I, compliance helpers, reports, syndication and the Flash AI desk copilot.

Honesty first: Features listed on our Roadmap are planned, not shipped. Nothing is presented as shipped until it appears in the Changelog and the docs.

2. Your dealership account

  • You must be authorized to create an account for your dealership.
  • You are responsible for the accuracy of your account information (business name, dealer licence, tax settings).
  • You are responsible for activity under your account credentials.

3. Your data

  • You own your dealership data. We process it to run the Service for you.
  • You can export your data; full export, webhooks and an open API shipped in Tier 1.
  • Deleting your account requests deletion of your data, subject to legal retention obligations.
  • FlashFender is the service provider; your dealership is the regulated party for dealer obligations under laws like the Ontario MVDA.

4. Acceptable use

You agree not to use the Service to:

  • Store or transmit data that is unlawful, or that you lack the right to process.
  • Attempt to access another dealership’s data or the Service’s infrastructure.
  • Reverse-engineer, scrape or disrupt the Service.
  • Send commercial electronic messages without required consent (CASL applies to your sends, and our tools track consent).

5. Flash AI

Flash AI is a draft-first copilot:

  • Every AI output is a draft you review before it is sent or posted. Flash AI never auto-sends.
  • AI claims are dealer claims: review generated content, including pricing and disclosure fields, before use.
  • Where AI is not configured, surfaces show an amber “Not configured” state.

6. Trial, billing and soft-lock

  • New dealerships get a free trial period (typically 7 days) on the live app.
  • When a trial or plan lapses, FlashFender applies a soft lock: you can still sign in and read, writes pause, and your data stays. Nothing is deleted.
  • Billing: new single-rooftop dealerships (Starter/Pro) are on the $50/mo new-dealership offer after the free trial; Group pricing is custom. Soft lock holds writes until paid unlock ships in-app. No one is charged a card on signup today. Published prices on the site replace any prior “starts at” / TBA language.

7. Availability and warranty

The Service is provided “as is” and “as available”. We work to keep it reliable, but do not warrant uninterrupted or error-free operation. To the maximum extent permitted by law, FlashFender disclaims implied warranties and, except as required by law, is not liable for indirect, incidental or consequential damages.

8. Termination

You can stop using the Service at any time and export or delete your data. We may suspend access for conduct that breaches these Terms, with notice where practical.

9. Changes

We may update these Terms and will post the new version here with an updated date. Material changes are announced in the changelog.
