CARFAX Canada, MVDA and the Canadian compliance map
A plain-language map of the rules Canadian dealers actually hit: PIPEDA, CASL, Ontario MVDA/OMVIC, Quebec Law 25, PIPA, FINTRAC LCTR and GST/HST.
Compliance for a Canadian dealership isn’t one law — it’s a map. Here’s the plain-language version, including where FlashFender helps and where we deliberately stay out.
The map
- PIPEDA (federal) — consent, purpose, access, accuracy and safeguards for personal information across Canada. We apply these principles platform-wide.
- CASL (federal) — commercial electronic messages need consent, identification and opt-out. Our CRM tracks consent and respects quiet hours.
- Ontario MVDA / OMVIC — the Motor Vehicle Dealers Act governs used-car sales, disclosures and records in Ontario. OMVIC administers it. (Not to be confused with the UCDA, which is a trade association.)
- Quebec Law 25 — privacy modernization with consent and transparency obligations. Same principles, provincial flavour.
- Alberta / BC PIPA — provincial personal-information acts with consent and access obligations.
- FINTRAC LCTR — dealers handling $10,000+ cash report Large Cash Transaction Reports. We can help organize the records.
- GST/HST — tax fields on deals and invoices, ready for accounting export.
Where FlashFender sits
One honest sentence: FlashFender keeps the records; your dealership is the regulated party.
We build helpers — MVDA-oriented BOS fields, known-damage notes, we-owes, consent records, quiet hours — into the flow where the deal happens. We are organizers, not legal counsel, and we don’t pretend to be a regulator or a law firm.
What we don’t do
- No NHTSA. That’s a US agency. CARFAX Canada is the history source we integrate.
- No invented compliance. Provincial registration (like OMVIC for Ontario dealers) stays the dealer’s responsibility.
